On December 8, 2003 the West Alabama Quality of Life Coalition (WALQ) filed a lawsuit in U. S. District Court (5th Circuit) for the Southern District of Texas. The Defendants in the lawsuit are The Texas Department of Transportation, The U. S. Department of Transportation, The Federal Highway Administration, The City of Houston, and The Metropolitan Transit Authority of Harris County. The lawsuit alleges that the parties did not comply with the National Environmental Policy Act, Section 4(f) of the Transportation Act, The Historical Preservation Act and other laws in plans to construct the current phase of the US-59/Spur527 project. WALQ asserts that the defendants have a traffic diversion plan that sends thousands of vehicles from the freeway into residential neighborhoods that was not disclosed in the required documents filed of record. WALQ is asking the court for a permanent restraining order until these matters are properly resolved.
